Brooks Pest Solutions Terms of Service
Please read these Terms of Service (“Terms”) carefully before using any services provided by Brooks Pest Solutions (“Company,” “we,” “us,” or “our”). By scheduling, requesting, or receiving pest control services from Brooks Pest Solutions, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.
Brooks Pest Solutions operates in Georgia, Florida, and Texas. These Terms apply to all services rendered in those states unless otherwise specified.
1. Services
1.1 Scope of Services
Brooks Pest Solutions provides residential and commercial pest control services, including but not limited to:
- General pest treatment (ants, cockroaches, spiders, rodents, and similar pests)
- Termite inspection, treatment, and monitoring
- Mosquito and outdoor pest control
- One-time treatments and recurring service plans
The specific services to be performed will be described in your service agreement, quote, or invoice.
1.2 Service Area
Services are available in select areas of Georgia, Florida, and Texas. We reserve the right to decline service in areas outside our coverage zones.
1.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any service at any time. If a scheduled service must be rescheduled due to weather, safety concerns, or other factors outside our control, we will notify you and arrange an alternate time. We are not liable for delays or failure due to events beyond our control (weather, natural disasters, supply shortages, etc.).
2. Scheduling and Access
2.1 Property Access
By scheduling a service or signing a contract, you authorize Brooks Pest Solutions and its technicians to enter and access your property, including interior and exterior areas, for the purpose of performing the agreed-upon pest control services. You represent that you have the legal authority to grant such access.
2.2 Preparation
You agree to follow any pre-treatment preparation instructions provided by our team. Failure to prepare the property as directed may result in reduced effectiveness and additional charges for re-treatment.
2.3 Cancellations and Rescheduling
You may cancel or reschedule a scheduled appointment with at least 24 hours’ advance notice at no charge. Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee as set forth in your service agreement. No-shows without prior notice may be charged the full service fee.
3. Payment Terms
3.1 Pricing
Service pricing will be provided in a written quote or service agreement prior to commencement of services. Prices are subject to change with reasonable notice, and any price changes will not apply to already-scheduled appointments.
3.2 Payment Due
Payment is due at the time of service unless you are enrolled in a recurring service plan with an established billing cycle. We accept major credit cards, debit cards, ACH, and check. Customers consent to storing a payment method on file, and agree to automatic recurring charges. Customers are responsible for updating expired cards.
3.3 Recurring Service Plans
If you enroll in a recurring service plan, you authorize us to charge your designated payment method on the agreed billing schedule. By providing a payment method, you represent that you are authorized to use it and that funds are available.
3.4 Late Payments
Balances not paid within 30 days of the due date may be subject to a late fee of 1.5% per month (or the maximum rate permitted by applicable law, whichever is less) on the outstanding balance. We reserve the right to suspend or terminate services for accounts with unpaid balances.
3.5 Returned Payments
Returned checks or failed electronic payments may result in a returned payment fee of up to $35, plus any applicable bank charges.
4. Service Guarantee and Re-Treatment
Pest Control is a process, not a one-time solution. While we strive to significantly reduce or eliminate pest activity, Brooks Pest Solutions does not guarantee complete or permanent eradication of pests.
Brooks Pest Solutions stands behind its work. If you experience continued pest activity within the warranty period specified in your service agreement, we will return to re-treat the affected area at no additional charge, provided.
- You notify us within the warranty period;
- The original service was performed on your property under normal conditions;
- You have followed all post-treatment instructions; and
- The continued activity is consistent with the original pest identified and treated.
This guarantee does not cover new infestations, structural conditions contributing to pest entry, or conditions arising after our service that create new pest pressure.
5. Customer Responsibilities
Successful pest control can be influenced by the state of the customers residence. For optimal results, we recommend customers:
- Maintain sanitation
- Fix structural issues (gaps, leaks, etc.)
- Secure pets
- Provide accurate infestation information
6. Chemical Treatments and Safety
6.1 Disclosure
Our technicians use EPA-registered pesticides and follow all applicable federal, state, and local regulations. Upon request, we will provide Safety Data Sheets (SDS) for any products used on your property.
6.2 Re-Entry Instructions
You agree to follow all re-entry and safety instructions provided by the technician following a treatment. These may include remaining out of treated areas for a specified period and ventilating treated spaces.Ω
6.3 Pets and Sensitive Individuals
You are responsible for removing pets, children, and individuals with known chemical sensitivities from treated areas during and for the period following treatment as directed. Please notify us of any known allergies or chemical sensitivities prior to service.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BROOKS PEST SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, PROPERTY DAMAGE, OR PERSONAL INJURY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability for any claim arising out of or related to a specific service shall not exceed the total amount paid by you for that specific service.
We are not liable for damage to property that is pre-existing, concealed, or caused by structural deficiencies, nor for pest damage that occurred prior to or after our service period.
Some examples of what we wouldn’t not be responsible for:
- Drywall cracks
- Drilling into hidden pipes/wires (unless negligent)
- Staining from treatments
- Landscaping damage (within reason)
8. Indemnification
You agree to indemnify, defend, and hold harmless Brooks Pest Solutions, its officers, employees, contractors, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your misrepresentation regarding property ownership or authority to grant access; or (c) your failure to follow safety or preparation instructions.
9. Arbitration and Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms or the services provided shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in the county where the services were rendered.
YOU AND BROOKS PEST SOLUTIONS WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS. Each party shall bear its own arbitration costs, except as may be awarded by the arbitrator.
Nothing in this section prevents either party from seeking emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which services are rendered, without regard to conflict of law principles:
- Services in Georgia: Governed by the laws of the State of Georgia.
- Services in Florida: Governed by the laws of the State of Florida.
- Services in Texas: Governed by the laws of the State of Texas.
11. Communications
11.1 Consent to Communications
By providing your contact information and/or scheduling services with Brooks Pest Solutions, you expressly consent to receive communications from us through the following channels:
- Phone calls (including automated or pre-recorded calls, where permitted by applicable law)
- Text messages and SMS notifications
- Email correspondence
- Direct mail to your service address
These communications may include appointment confirmations, service reminders, follow-up notifications, invoices, account alerts, and promotional or marketing materials related to Brooks Pest Solutions’ services.
11.2 Call Recording
YOU ACKNOWLEDGE AND AGREE THAT TELEPHONE CALLS AND VIDEO CALLS WITH BROOKS PEST SOLUTIONS MAY BE MONITORED AND/OR RECORDED for quality assurance, training, dispute resolution, and business operations purposes. By initiating or accepting a call with us, you consent to such recording. If you do not consent to call recording, please notify the representative at the start of the call; however, we reserve the right to decline service if we are unable to record for compliance or training purposes.
11.3 Data Storage and Use for Marketing and Training
Information collected through your communications with us — including call recordings, email content, text message exchanges, and interaction data — may be stored and used for the following purposes:
- Staff training and quality improvement
- Internal business analytics and reporting
- Future marketing and advertising campaigns directed to you, based on your service history and preferences
- Development and improvement of our customer service processes
We may use aggregated or de-identified communication data to improve our marketing strategies and service offerings. We will not sell your personal communication data to unaffiliated third parties for their own independent marketing purposes without your separate consent.
11.4 Text Message Communications
By providing a mobile phone number, you consent to receive SMS/text messages from Brooks Pest Solutions. Message and data rates may apply. Message frequency will vary. You may opt out of text communications at any time by replying STOP to any text message from us. For help, reply HELP. Opting out of text messages will not affect your ability to receive services, though it may limit your ability to receive time-sensitive service notifications.
11.5 Email Communications
By providing your email address, you consent to receive transactional and marketing emails from Brooks Pest Solutions. You may unsubscribe from marketing emails at any time by clicking the “unsubscribe” link in any marketing email or by contacting us directly. Transactional emails (such as invoices, appointment confirmations, and account notices) are not subject to marketing opt-out and will continue as necessary for the performance of your service agreement.
11.6 Do Not Call / Communication Preferences
If you are registered on a federal or state Do Not Call list, your submission of a service request or signing of a service agreement constitutes your express written consent to be contacted by Brooks Pest Solutions as described in these Terms, including via automated dialing systems, for purposes related to your service. You may update your communication preferences at any time by contacting us in writing.
12. Privacy
We collect and use personal information in accordance with our Privacy Policy, which is incorporated herein by reference. We do not sell your personal information to third parties. Information collected during the course of service (including contact, property, and payment information) is used solely to provide and improve our services.
13. Termination
Either party may terminate a recurring service agreement with written notice as specified in the service agreement; however, all service agreements are subject to a minimum initial term of twelve (12) months.
If the customer elects to terminate the agreement prior to the completion of the initial 12-month term, an early cancellation fee will apply. This fee shall be equal to the full amount of any initial service discount or promotional pricing provided at the start of the agreement and must be paid in full at the time of cancellation.
In the event of early termination, any unused or scheduled re-services, follow-up treatments, or service guarantees are forfeited and will not be honored or refunded.
We reserve the right to immediately terminate services for non-payment, abuse of staff, unsafe property conditions, or violation of these Terms. Upon termination for any reason, all outstanding balances, including any applicable cancellation fees, become immediately due and payable.
14. Modifications to These Terms
We reserve the right to update or modify these Terms at any time. Updated Terms will be posted on our website at www.brookspestsolutions.com and will be effective upon posting. Your continued use of our services after any such changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
15. Entire Agreement
These Terms, together with your service agreement and any applicable addenda, constitute the entire agreement between you and Brooks Pest Solutions with respect to the subject matter hereof and supersede all prior or contemporaneous communications, whether written or oral.
